Terms and conditions of the online store telesalon.en of 1 november 2017

    1. Definitions

      The terms used in the Regulations shall mean:

      1. Customer - a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, who makes an Order from the Store;
      2. Consumer - in accordance with Article. 22[1] of the Civil Code means a natural person making a legal transaction with an entrepreneur that is not directly related to his/her business or professional activity.
      3. Civil Code - Law of April 23, 1964. (OJ.U. No. 16, pos. 93 as amended.);
      4. Regulations - these Regulations for the provision of services by electronic means within the framework of the online store telesalon.pl;
      5. Online Shop (Store) - internet service available at telesalon.pl, through which the Customer can, in particular, place Orders;
      6. Merchandise - products presented in the Online Store;
      7. Sales contract - contract of sale of Goods in the meaning of the Civil Code, concluded between the Trade and Service Company Karol Halicki and the Customer, concluded using the Store's website;
      8. Consumer Rights Act - Law of May 30, 2014. on consumer rights (Dz.U. of 2014. pos. 827);
      9. Law on provision of electronic services - Law of 18 July 2002. on the provision of services by electronic means (Dz. U. No. 144, item. 1204 as amended.);
      10. Order - Customer's declaration of intent, aimed directly at concluding a Sales Agreement, specifying in particular the type and number of Goods.
    2. General provisions
      1. These Regulations set out the rules for the use of the online store available at: telesalon.en.
      2. These Regulations are the regulations referred to in Art. 8 Law on Provision of Electronic Services.
      3. Online store, operating at the address: telesalon.pl, is run by the Trade and Service Company Karol Halicki.
      4. In particular, these Regulations set forth:
        1. rules for registration and use of an account within the online store;
        2. terms and conditions for making electronic reservations for products available through the online store;
        3. terms and conditions for placing electronic Orders within the online store;
        4. the rules for concluding Sales Agreements using the services provided by the online store.
      5. The use of the online store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements:
        1. Internet Explorer version 11 or later with JavaScript enabled, or
        2. Edge version 14 or later with JavaScript enabled, or
        3. Chrome version 49 or later with JavaScript enabled, or
        4. Firefox version 52 or later with JavaScript enabled, or
        5. Opera version 12 or later with JavaScript enabled, or
        6. Safari version 4 or later with JavaScript enabled
        7. minimum screen resolution of 1024 x 768 pixels.
      6. In order to use the online store, the customer should on his own access to a computer workstation or a terminal device with Internet access.
      7. In accordance with applicable law, Karol Halicki Trade and Service Company reserves the right to limit the provision of services through the Online Store to persons who are at least 18 years old. In this case, potential customers will be notified of the above.
      8. Customers may access these Terms and Conditions at any time through the link provided on the home page of the website telesalon.pl and download it and make a printout of it.
    3. Rules of using the Online Store
      1. The condition to start using the Online Store is to register with it.
      2. Registration takes place by completing and accepting the registration form, made available on one of the pages of the Store.
      3. The condition of registration is agreeing to the content of the Regulations and providing personal data marked as mandatory.
      4. Karol Halicki Trading and Service Company may deprive the Client of the right to use the Online Store, as well as may restrict the Client's access to some or all of the Online Store's resources, with immediate effect, in case of violation of the Terms and Conditions by the Client, and in particular when the Client:
        1. provided during registration in the Online Store data that are untrue, inaccurate or outdated, misleading or violating the rights of third parties,
        2. has committed, via the Online Store, a violation of the personal rights of third parties, in particular the personal rights of other customers of the Online Store,
        3. commits any other behavior that will be considered by the Trade and Service Company Karol Halicki as inconsistent with applicable law or general rules of Internet use, or harming the good name of the Trade and Service Company Karol Halicki.
      5. A person who has been deprived of the right to use the Online Store may not register again without the prior consent of Karol Halicki Trading and Service Company.
      6. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the degree of security threat to the services provided, in particular, measures to prevent unauthorized persons from obtaining and modifying personal data transmitted on the Internet.
      7. In particular, the customer is obliged to:
        1. not to provide or transmit content that is prohibited by law, such as content that promotes violence, is defamatory or violates the personal rights and other rights of third parties,
        2. use of the Online Store in a manner that does not interfere with its operation, in particular through the use of specific software or devices,
        3. not to take actions such as: sending or posting unsolicited commercial information (spam) within the Internet Store,
        4. use of the Online Store in a manner that is not onerous for other customers and for the Trade and Service Company Karol Halicki,
        5. use any content posted within the Online Store only for your own personal use,
        6. use of the Online Store in a manner consistent with the provisions of the laws in force on the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general rules of Internet use.
    4. Procedure for conclusion of a sales contract
      1. Information about the Goods provided on the Store's website, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a contract, as defined in Art. 71 of the Civil Code.
      2. In order to conclude a Sales Agreement through the Online Store, one should visit the website telesalon.pl, make a selection of goods by taking subsequent technical actions based on the messages displayed to the customer and the information available on the website.
      3. The selection of the Goods ordered by the Customer is made by adding them to the shopping cart.
      4. During the process of placing the Order - until the button "e.g. Order with obligation to pay or other equivalent informing about the obligation to pay" is pressed - The Customer has the possibility to modify the entered data and the selected Goods. To do so, follow the messages displayed to the customer and the information available on the website.
      5. After the Customer using the Online Store has provided all the necessary data, a summary of the submitted Order will be displayed. The summary of the submitted Order will include information on:
        1. the subject of the order,
        2. the unit and total price of the ordered products or services, including delivery costs and additional costs (if any),
        3. the selected payment method,
        4. the selected method of delivery,
        5. delivery time
      6. In order to send an Order, it is necessary to accept the content of the Terms and Conditions, provide personal data marked as mandatory and press the button "Order with obligation to pay" .
      7. Sending an Order by the Customer constitutes a declaration of intent to conclude a Sales Contract with Firma Handlowo-Usługowa Karol Halicki, in accordance with the content of the Regulations.
      8. After placing the Order, the Customer receives an e-mail message entitled "Order Confirmation No. XXXXX", containing the final confirmation of all important elements of the Order.
      9. The contract shall be deemed concluded upon receipt by the Customer of the e-mail message referred to above.
      10. The contract of sale is concluded in the Polish language, with the content in accordance with the Regulations.
      11. Customers may access these Terms and Conditions at any time through the link provided on the home page of the website telesalon.pl and download it and make a printout of it.
      12. Recording, securing and making available the data of the Order and the General Terms and Conditions (terms and conditions of the online store) is done via e-mail.
    5. Delivery
      1. Delivery of ordered Goods is made by DPD courier service. Delivery costs are 12 PLN for prepaid shipments and 15 PLN for postal shipments. Delivery costs will also be indicated at the time of placing the Order.
      2. The delivery period is from 1 to 3 working days counting from the day the Customer sends the Order.
    6. Prices and payment methods
      1. The prices of the Goods are quoted in Polish zloty and include all components, including VAT (distinguished by the rate), customs duties and any other components.
      2. The customer has the option to pay the price:
        1. by bank transfer to the bank account number 37 1050 1823 1000 0091 2158 9387,
        2. payment in the IAI Pay system,
        3. cash on delivery

    1. Right of withdrawal
      1. Only the Customer who is also a Consumer is entitled to a 14-day period to withdraw from the contract. The consumer has the right to withdraw from this contract within 14 days without giving any reason. The period for cancellation expires after 14 days from the day on which you took possession of the goods or on which a third party other than the carrier and indicated by you took possession of the goods.
      2. To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by mail, fax or e-mail).
      3. You may use the model withdrawal form, but this is not mandatory.
      4. In order to comply with the withdrawal period, it is sufficient for you to send information concerning the exercise of your right of withdrawal before the expiry of the withdrawal period.
    2. Effects of withdrawal from the contract
        1. In the event of withdrawal from this contract, we will return to you all payments received from you, including the costs of delivery of the goods (except for the additional costs resulting from your choice of delivery method other than the cheapest ordinary delivery method offered by us), immediately and in any case not later than 14 days from the day on which we are informed of your decision to exercise your right of withdrawal from this contract. We will refund your payment using the same means of payment that you used in the original transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees in connection with this refund.
        2. We may withhold reimbursement until you receive the item or until you provide us with proof of return, whichever event occurs first

  1. Complaints about Goods
    1. Karol Halicki Trade and Service Company, as a seller, is liable to the Customer who is a Consumer within the meaning of art. 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular, in Art. 556 and Art. 556[1] - 556[3] et seq. of the Civil Code.
    2. Complaints arising from violation of rights guaranteed by law, or under these Regulations, should be addressed to complaints@telesalon.en. [Online store operator] undertakes to process each complaint within 14 days. Failure to consider the complaint within the above period means that it is considered justified.
    3. Karol Halicki Trade and Service Company is not a manufacturer of goods. The manufacturer is liable under the warranty of the sold Goods under the conditions and for the period indicated in the warranty card. If the warranty document provides for this possibility, the customer may submit his claims under the warranty directly to the authorized service center, the address of which can be found in the warranty card.
  2. Complaints regarding the provision of services by electronic means
    1. Karol Halicki undertakes to ensure fully correct operation of the Store to the extent resulting from current technical knowledge, and undertakes to remove all irregularities reported by the Customers within a reasonable period of time.
    2. The customer is obliged to immediately notify Karol Halicki Firma Handlowo-Usługowa of any irregularities or interruptions in the functioning of the service of the Internet Shop.
    3. Irregularities related to the functioning of the Store, the Customer may report in writing to contact@telesalon.pl or by using the contact form.
    4. In a complaint, the Customer should provide his/her name, mailing address, type and date of occurrence of irregularities related to the functioning of the Store.
    5. Karol Halicki Trade and Service Company undertakes to consider each complaint within 14 days. Failure to consider the complaint within the above period means that it is considered justified.
  3. Dispute resolution and final provisions
    1. The customer, who is a Consumer, may, if interested, use the out-of-court ways of handling complaints and asserting claims. Disputes over online shopping can be resolved through mediation proceedings before the Provincial Inspectorates of Trade Inspection or a trial before an arbitration court at the Provincial Inspectorate of Trade Inspection. Consumers can also use other methods of out-of-court dispute resolution and, for example, file their complaint through the EU's online ODR platform, available at: http://ec.europe.eu/consumers/odr/
    2. In the absence of interest on the part of the Consumer in the possibility to use out-of-court dispute resolution, the resolution of any disputes arising between Firma Handlowo-Usługowa Karol Halicki and the Consumer will be subject to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
    3. Settlement of any disputes arising between Firma Handlowo-Usługowa Karol Halicki and a Customer who is not also a Consumer, will be submitted to the court having jurisdiction over the seat of Firma Handlowo-Usługowa Karol Halicki.
    4. Matters not covered by these Regulations shall be governed by the provisions of the Civil Code, the provisions of the Act on Rendering Electronic Services and other relevant provisions of Polish law.
